Watching Nando's video is pretty conclusive, Vettel overtook under yellows therefore needs penalising. It's pretty sad though, and Vettel deserves the championship, but rules can't and shouldn't be ignored.
Ferrari are in a hugely awkward position, even if they do not appeal directly, the FIA have to reveiw the evidence and Ferrari stand to have a world champion and the person who loses is out is the driver they are mooted to be signing or have already signed for 2014.
It is clear he passes before the green light, so I don't see if any kind of consistency is applied that a punishment cannot be given. It's not the right way to win or lose the title, but this isn't a technicality, you can't overtake under yellows for safety reasons.
* if they do nothing when something would clearly be done if it was the first race, then they're open to accusations of corruption and favouritism
* if they do something and give a penalty to Vettel that takes the championship away, then F1 becomes a laughing stock amongst those who don't understand the rules
