Actually you can't. If you have no capacity to make reasoned judgement your consent means nothing and it is considered reckless to rely upon such consent.

All correct. In a medico-legal scenario you would be screwed.

But that is why McDonald got away with it IMO, because the evidence available suggests he may have thought there was some consent given.

Were I still in my previous career in the law, a conviction like this would have seen me disbarred. A doctor would be struck off. Evans has a right to work but I fail to see why he should go back into football.

I totally disagree. He should be allowed to get on with his life but IMO he lost the right to pursue his career as a professional footballer when he committed rape. Personally, I don't think that anybody who is on the sex offenders register should have a job where kids look up to and idolise them.
