You still have reasonable man tests in criminal law which are the same concept.
I know that, but there are different tests applied to criminal law IIRC. The Clapham omnibus definition rests on duty of care and negligence.

You have no idea what the context is for why that has happened. Maybe listen to that first before posting your reductive rubbish as advice.

My best ever win (against Harrow Trading Standards in the Court of Appeal) was a due diligence case. I was absolutely staggered when one of the Law Lords said that "if one is not negligent, then one should be, at least prima facie, considered to have been diligent"

My barrister turned to me and whispered - "that's us in the All England's then!"

Labour would be better saying their manifesto pledge re working people was based on the figures available and the OBR has confirmed they were at least £20bn out. That being the case they are going to ensure no tax rises for those people who are living month to month on their current earnings. Point out the alternative is schools, the NHS and every other public service will suffer further cuts which is completely unacceptable given the shit show the Tories left after 14 years.
 
Agree he should resign immediately tbh, it's not self defence, it's a shellacking. The whole 'two-tier' thing is already massive, a common assault charge and the maximum sentence of 6 months isn't going to help that
No, but it's the law, just like any of the other false equivalence bullshit about Huw Edwards or whatever other none comparable case thrown around is. As far as I'm aware Labour have done nothing to sentencing guidelines or passed zero laws in this area, everything is as it would have been 6 months ago.

He has a thumping majority and 5 years. This is the way it's going to be, he can't be rabbit eared to it, nothing will change whatever he does. Fuck them.

I don't think any group is going to get particularly clobbered tbh, other than an increase to CGT. Obviously the NI increase will just get taken out of any 2025 salary increases to cover that, so working people end up paying it anyway
