He 'got away' with it because it was a civil case not a criminal one. A lot of civil cases are settled out of court.

If there were no charges made at the time then that's it. That is down to the police and CPS at the time. Plus there is a higher burden of proof in a criminal case. Reasonable doubt versus balance of probabilities.

She accepted the deal, including no admission. So the civil case never made it to a court. Happens in so many civil cases.
