The referee has said he saw it and didn't deem it a foul so I think the football authorities hands are tied. That might change when the legal authorities get involved. There is a potential for criminality, and the action is sufficiently outside the normal boundaries of play in football that a civil suit would probably get around the volenti defence and have a good chance of success as well.

Looking at it from the refs perspective it was hard to give either way not saying it wasn’t a foul.
