All we had to do was not give the pass interference penalty on your third and 5 on the 14 and we win 12-7, but that wouldn't have been half as much fun.
My best ever win (against Harrow Trading Standards in the Court of Appeal) was a due diligence case. I was absolutely staggered when one of the Law Lords said that "if one is not negligent, then one should be, at least prima facie, considered to have been diligent"
My barrister turned to me and...
The issue he has is that if the other bloke (and this is supposition on my part) had engaged in a long campaign of offensive stuff, then that doesn't fulfil the provocation defence for this incident in and of itself, because the reaction isn't immediate, looking at the footage.
Now he could...
The most famous provocation defence was a bloke who came home to find a burglar raping his wife in the kitchen so smacked the bastard round the head with a saucepan as it was the nearest thing to hand and killed him
Reaction has to be immediate, proportionate to the threat, and reasonable to...
If he tries to run a provocation defence it will be a very hard road indeed. First you need to show the provocation happened, and then it is the man on the Clapham omnibus test about whether the reaction provoked was proportionate and acceptable.
Not seeing a lot of either in the pictures...
Shambolic by the Bears, but I will take it.
Washington v Philly games later in the season could be fun, plus as always we have two left against the unmentionables from Texas.
Support announced
Ace - Suicidal Tendencies (presumably Robert Trujillo will guest with them on one song each night - make it Send Me Your Money and I will be very happy)
Meh - Evanescence - two hit wonders and I can't say I am a huge fan at all.
The problem is the succession of beatings and the lack of a win since Luton has almost certainly dented morale and we don't know how to win. Maybe the late comeback at Brighton might breed a bit of confidence but it is a bit of leap to see it being the catalyst to a strong surge in form.
But surely if you change the engine of a Cosworth you are removing it's raison d'etre and it is a spoiler and an airdam away from being a regular Escort or Sierra?
Plus are they classics? I was old enough to drive them when they arrived on the scene I think. I feel old!
